By using www.netbact.com ("this Website"), you agree to the ‘Terms of Service’ mentioned below. If you do not agree with the ‘Terms of Service’, you are requested to not use the website, www.netbact.com and the accompanying products & services. By using the website, you agree that Netbact can modify the mentioned ‘Terms of Service’ at any time and you agree to be bound by all the changes/modifications that Netbact may reasonably make hereto.
1. Using our Services
You must follow any policies made available to you within the Services.
You agree that you will not misuse the Services. You also agree that you will not interfere with the Services or try to access it using a method other than the interface and the instructions that Netbact provides. You agree to use the Services only as permitted by law, including the applicable laws and regulations. Netbact may suspend or stop providing the Services to you at any point in time if you do not comply with the mentioned terms or policies or if Netbact is investigating the suspected misconduct.
You agree that using the Services does not give you ownership of any intellectual property rights in the Services or the content you access. You may not use the content from the Services unless you obtain permission from its owner or are otherwise permitted by law. These ‘Terms of Service’ do not grant you the right to use any Intellectual Property Rights used in the Services.
In connection with your use of the Services, Netbact may send you the service announcements, administrative messages, and other information. You may opt-out of some of those communications.
2.Your Account
You may have to create an account in order to use our Services. We provide a platform vide which you can create a digital business card. You will be able to upload your videos and photos and can create your digital business card for promotion of your business and for personal use. You can also opt for our ‘refer and earn’ policy vide which you can earn commission for promotion of the website. The commission policy can be changed at any time without prior intimation. Please also note that you have to provide your PAN for TDS certificate if the commission amount exceeds Rs. 15,000/- in a year. You may also use media URLs in the digital business card.To protect your Account, you are requested to keep your password confidential. You and solely you are responsible for the activity that happens on or through your Account. Please try not to reuse your Account password on third-party applications. If you learn of any unauthorized use of your password or Account, please change your password immediately. Netbact will not be responsible for any unauthorised use by any third party.
3. WEBDEALER
Any Netbact Customer who updates his KYC with the Company and promotes Netbact Services/ Products shall be considered as a Webdealer. Webdealer is a person who creates an Account in Netbact and uses webcard and promotes it further.
Webdealer shall be entitled to commission on sale of Webcard. Webdealer has to comply with & follow all the rules and policies with regard to PAN CARD and Account Details. Webdealer shall be entitled to “Refer and Earn” which allows them to earn commission on promotion of the website.
4. Privacy and Copyright Protection
Netbact’s privacy policies explain how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that Netbact can use such data in accordance with our privacy policies.
We respond to notices of alleged copyright infringement and terminate accounts of repeat infringers according to the process set out in the Indian Copyright Act.
5. Your Content in our Services
Some of our Services allow you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. In short, your content remains to you.
When you upload, submit, store, send or receive content to or through our Services, you give Netbact a worldwide license to use, host, store, reproduce, modify, create derivative works (such as those resulting from translations, adaptations or other changes we make so that your content works better with our Services), communicate, publish, publicly perform, publicly display and distribute such content. The rights you grant in this license are for the limited purpose of operating, promoting, and improving our Services, and to develop new ones. This license continues even if you stop using our Services. Some Services may offer you ways to access and remove content that has been provided to that Service. Also, in some of our Services, there are terms or settings that narrow the scope of our use of the content submitted in those Services. Make sure you have the necessary rights to grant us this license for any content that you submit to our Services.
If you have a Netbact Account, we may display your Profile name, Profile photo, and actions you take on our website or on third-party applications connected to us in our Services, including displaying in ads and other commercial contexts. We will respect the choices you make to limit sharing or visibility settings in your Account.
You can find more information about how Netbact uses and stores content in the privacy policy or additional terms for particular Services. If you submit feedback or suggestions about our Services, we may use your feedback or suggestions without obligation to you.
6. Modifying and Terminating our Services
We are constantly changing and improving the Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether.
You can stop using our Services at any time, although we’ll be sorry to see you go. Netbact may also stop providing Services to you, or add or create new limits to our Services at any time.
We believe that you own your data and preserving your access to such data is important. If we discontinue a Service, where reasonably possible, we will give you advance notice and a chance to get information out of that Service.
7. Our Warranties and Disclaimers
Other than as expressly set out in these terms or additional terms, neither Netbact nor its suppliers or distributors make any specific promises about the Services and commission. For example, we don’t make any commitments about the content within the Services, the specific functions of the Services, or their reliability, availability, or ability to meet your needs. We provide the Services “as is”.
Some jurisdictions provide for certain warranties, like the implied warranty of merchantability, fitness for a particular purpose and non-infringement. To the extent permitted by law, we exclude all warranties.
8. Liability for our Services
When permitted by law, Netbact, and Netbact’s suppliers and distributors, will not be responsible for lost profits, revenues, or data, financial losses or indirect, special, consequential, exemplary, or punitive damages.
To the extent permitted by law, the total liability of Netbact, and its suppliers and distributors, for any claims under these terms, including for any implied warranties, is limited to the amount you paid us to use the Services (or, if we choose, to supplying you the Services again).
In all cases, Netbact, and its suppliers and distributors, will not be liable for any loss or damage that is not reasonably foreseeable.
We recognize that in some countries, you might have legal rights as a consumer. If you are using the Services for a personal purpose, then nothing in these terms or any additional terms limits any consumer legal rights which may not be waived by contract.
9. Business uses of our Services
If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify Netbact and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.
10. About these Terms
We may modify these terms or any additional terms that apply to a Service to, for example, reflect changes to the law or changes to our Services. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. We’ll post notice of modified additional terms in the applicable Service. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a Service or changes made for legal reasons will be effective immediately. If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict.

11.Representations
You represent that you are an Indian Citizen, at least 18 years old and have provided and will continue to provide accurate and correct information to www.netbact.com. You represent that you have full authority to enter into this agreement and perform its terms. You warrant that each action you make is being done so in good faith and that you have no knowledge of it infringing upon or conflicting with the legal rights of any third parties.
12. Venue and Choice of Law
This Agreement shall be governed by and construed in accordance with the laws of India. All disputes arising out of or in connection with this Agreement shall be exclusively brought in the jurisdiction of courts at Jodhpur, Rajasthan, India. You agree to not challenge the jurisdiction of this Agreement, and waive any objections thereto, including but not limited to those objections arising from conflict of laws principles. If You commence legal proceedings in breach of terms of this Agreement, Netbact shall be entitled to all of its legal fees and costs of enforcing the terms of this Agreement, including collection, on a substantial indemnity basis which shall be payable forthwith.
13. Content
Although Netbact strives to update and keep accurate as much as possible the content contained on this Website, errors and/or omissions may occur. The content contained in the website or which may be downloaded from the website is provided "as is" and "as available". As such, Netbact makes no warranty or representation regarding the quality, accuracy or completeness of such content and expressly disclaims liability for errors and/or omissions in said content. 14. Communication with Netbact
All messages, responses, and other communication between you and the Netbact, including but not limited to e-mails, voicemails, and webpages are confidential and/or subject to copyrights. 15. Limitation of Liability

17. Force Majeure
Netbact is not liable for failure to perform its obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disasters), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity, internet or telephone service.

If any provision of this agreement shall be held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions of this agreement shall not in any way be affected or impaired thereby. Netbact will amend or replace such provision with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of www.netbact.com as reflected in the original provision.
